Copyright & DMCA Takedown
Last updated: September 2026
DigiArte respects the rights of designers. If a listing on DigiArte uses your work without permission, tell us and we will review it quickly. This process follows the notice-and-takedown model of the US Digital Millennium Copyright Act (DMCA) and similar laws in other countries.
1. How to report
- Fastest: use the online copyright notice form. You get a case number straight away and email updates at every step.
- Or email support@digiarte.io with the subject "Copyright notice" and every item listed in section 2.
- Creators can register their designs under Copyright & DMCA → Protect my work. New uploads that look like a registered design are sent to our team automatically.
- If you bought the file, you can also choose Report on the product page and explain the copyright problem. You can follow it under My reports.
2. What a notice must include
- Your full name and a physical or electronic signature (typing your full name is accepted).
- A description of the original work, with a link or file showing that you created or own it.
- The DigiArte product link(s) you believe infringe your work.
- Your email address, phone number and postal address.
- A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorised to act for the owner.
3. What happens next
- We review complete notices, usually within 2 business days.
- If the notice is valid, the listing is disabled and new sales stop. The creator is told why and receives a copy of the notice.
- Earnings from sales of the disputed listing in the last 90 days are held while the case is open.
- Confirmed infringement adds a strike to the creator's account; three strikes close it under our Repeat Infringer Policy.
- Buyers who already purchased the file keep their licence. Each delivered file carries the buyer's order number so leaked copies can be traced.
Automatic originality checks
Every new listing's images are compared with existing listings and registered works. Near-identical copies are hidden until our team reviews them; weaker matches stay online while they are checked. Creators can answer an automatic hold with a counter-notice just like a formal notice.
4. Counter-notice
If your listing was removed and you believe this was a mistake, or that you have the right to sell the design, open Copyright & DMCA in your creator dashboard and choose File counter-notice on the case. The form asks for:
- Your name, signature, email, phone number and postal address.
- The removed listing link.
- A statement under penalty of perjury that you believe in good faith the listing was removed because of a mistake or misidentification.
- Your consent to the jurisdiction of the courts where you live (or, if you live outside the United States, any judicial district in which DigiArte may be found), and that you will accept service of process from the person who sent the original notice.
We forward valid counter-notices to the person who reported the listing. If they do not tell us within 14 calendar days (about 10 business days) that they have started legal action, the listing and any held earnings are restored automatically.
5. Misuse
Knowingly false notices or counter-notices can make the sender liable for damages. Accounts that abuse the reporting process may be suspended.
