Repeat Infringer Policy
Last updated: September 2026
DigiArte closes the accounts of creators who repeatedly sell work that infringes other people's copyright or trademarks. This policy explains how strikes are counted.
1. What counts as a strike
- A strike is added when our team confirms that a listing infringes someone's rights and removes it permanently after a valid copyright notice or an originality check.
- One case counts as one strike, even if it covers several listings.
- No strike is added when a notice is rejected, or when a listing is restored after a counter-notice.
- Our team may remove a listing without a strike, for example when the creator made an honest mistake and fixed it at once.
2. What happens at each strike
- First strike: the listing is removed and you get a warning by notification and email.
- Second strike: the listing is removed and your account is marked for closer review of new uploads.
- Third strike: your creator account is closed, every remaining listing is taken down and you may not open a new account.
3. Earnings
While a case is open, earnings from sales of the disputed listing in the last 90 days are held. If the listing is restored, the hold is released. If the listing is removed, the held amount may be used to refund buyers or settle the rights holder's claim.
4. Buyers
Buyers who purchased a removed listing in good faith keep access to their download. Refunds follow the Refund Policy.
5. Appeals
If you think a strike is wrong, file a counter-notice from Copyright & DMCA while the case is open, or contact us through the contact page within 30 days of the decision.
